Summary#

This bill directs the Environmental Protection Agency (the Administrator) to set water quality criteria, testing methods, monitoring, and effluent limits for perfluoroalkyl and polyfluoroalkyl substances (PFAS). It defines key terms and what "measurable" means for PFAS. The EPA must publish human health water quality criteria for each measurable PFAS or class within 3 years of enactment. The bill sets deadlines for final effluent limitations guidelines and standards for specific industry categories: by September 30, 2026 for organic chemicals/plastics/synthetic fibers, electroplating, and metal finishing; by September 30, 2027 for textile mills and landfills; and by September 30, 2028 for leather tanning/finishing, paint formulating, and plastics molding/forming. Effective on enactment, the EPA must require monitoring of PFAS discharges for those industry categories and also require monitoring for pulp/paper/paperboard, airports, and electrical and electronic components. The EPA must decide by December 31, 2026 whether to develop effluent guidelines for the pulp/paper, airports, and electrical/electronic categories; any such guidelines must be published by December 31, 2028. The EPA must promulgate Method 1633A (or a successor method of equal or greater validity) under part 136 by January 31, 2026 for measuring PFAS. The bill requires the Administrator to notify congressional committees of each publication. It authorizes grants for pretreatment program activities for publicly owned treatment works and monitoring of local PFAS sources. Sponsor: Senator Kirsten Gillibrand. Expenses#

The bill authorizes $200,000,000 per fiscal year for each of fiscal years 2026 through 2030 for pretreatment grants to publicly owned treatment works, to remain available until expended. It also authorizes $12,000,000 per fiscal year for each of fiscal years 2026 through 2030 to carry out the rest of the section (except the pretreatment subsection), to remain available until expended.
