This bill directs the Secretary of Agriculture (through the Forest Service) to issue a special use permit to place and maintain a flagpole bearing the flag of the United States at Kyhv Peak Lookout Point in the Uinta National Forest, Utah. The permit term is 10 years. The bill defines a "covered flagpole," the Kyhv Peak location by coordinates, and who counts as a "qualified person." The bill gives a first opportunity for the permit to Robert S. Collins of Provo, Utah, and if he declines, the permit may go to a qualified person from Utah County who applies. The Secretary may set terms and conditions, may authorize reasonable access for permit use, and must publish notice of permit availability on the Forest Service website and in a local Utah County newspaper. The bill exempts the permit from land use fees and says the National Environmental Policy Act (NEPA) does not apply to issuing, renewing, or administering this permit, including placing, maintaining, or removing the flagpole. The Secretary must issue or renew permits within 180 days in most cases and may terminate a permit early for noncompliance.
