Protection Against Foreign Adversarial Artificial Intelligence Act of 2025

Summary#

This bill stops federal contractors with active federal contracts from using the DeepSeek application or any successor app or service developed or provided by High Flyer to carry out or support a federal contract. The Secretary of Commerce, after consulting the Secretary of Defense, may grant a case-by-case waiver for national security objectives or for research.

The bill also requires the Secretary of Commerce, in consultation with the Secretary of Defense, to deliver a detailed report within 1 year to several congressional committees. The report must analyze threats to national security from AI platforms (including large language models and generative AI) that are based in or affiliated with "countries of concern." Required report topics include censorship laws and capacities, use of AI for state-sponsored propaganda, national security impacts from circumvention of export controls on graphics processing units, and privacy and data security risks to United States data (including data storage location, possible access by foreign governments including the Chinese Communist Party, contributions of U.S. data to AI development, risks of economic espionage, and risks to federal information). The report must be unclassified but may include a classified annex, and it must include recommendations for administrative and legislative action.
